Microsoft and OpenAI Tore Up the Old Deal

Microsoft no longer has exclusive rights to OpenAI's models. That alone is the biggest sentence in AI this year.

The numbers, dropped jointly on April 27. Microsoft's IP license now extends through 2032, but it's non-exclusive. OpenAI keeps paying Microsoft a 20% revenue share through 2030, but with a total cap. Microsoft will no longer pay OpenAI anything. Azure stays the primary cloud and OpenAI products still ship on Azure first, unless Microsoft cannot or chooses not to support what's needed. That last clause is doing a lot of work.

Why this matters. The original 2019 agreement was the deepest cloud-AI lock-in in the industry. Now OpenAI can sign with Amazon, Google, Oracle, anyone. CoreWeave, Crusoe, every neocloud just got upgraded from "GPU vendor" to "potential primary partner." Last week's $50B OpenAI-Amazon rumor instantly went from speculation to mechanical possibility. Microsoft gives up the model exclusivity it has been selling Azure customers on, and in exchange gets revenue certainty until 2030 plus the legal cleanup that was apparently blocking other deals. TechCrunch's framing was that this "ends Microsoft legal peril over OpenAI's $50B Amazon deal" - that's the actual unblock.

For agent builders. Today's stack assumed OpenAI lives in Azure first. Tomorrow's stack assumes whoever has the cheapest H200/B300 capacity. The agent company that's been writing direct OpenAI SDK calls is unaffected. The Azure customer who routed everything through Microsoft's enterprise wrappers just got an option they didn't have yesterday.

The under-discussed angle. The Microsoft revenue share goes through 2030 "independent of OpenAI's technology progress." Translation: even if OpenAI ships AGI tomorrow and Microsoft is irrelevant, Microsoft still gets 20% capped through 2030. They paid for that with the exclusivity, and they got it. Both sides got the divorce they needed.
