Washington Says Moonshot Copied Fable. Now Sanctions Are on the Table.
The White House accused Moonshot AI of distilling Anthropic's Fable to build Kimi K3, and the Treasury Secretary responded with a line he clearly rehearsed: open source is not open season on American IP. Scott Bessent said covert, industrial-scale distillation attacks that cross into IP theft put sanctions and Entity List designations on the table. That is a very different sentence from the usual scolding about export controls.
Here is the timeline that makes people uncomfortable. Fable went public July 1. Kimi K3 shipped as open weights in the middle of July, competitive with frontier models on coding and agentic benchmarks, and got a Hacker News thread with 847 points arguing that K3 plus Fable together is state of the art. Three weeks between one model going public and another allegedly derived model arriving at the frontier. Michael Kratsios, who runs science and tech policy for the White House, also alleged Moonshot obtained Nvidia GB300 servers, banned for Chinese sale under export controls, and accessed them from Thailand.
The technical claim is the weak part and everyone in the field knows it. Distillation is real, cheap and widely practiced, but three weeks of API access to a model does not get you a from-scratch frontier open-weights release with K3's breadth. Researchers pushing back are not defending Moonshot so much as pointing out that the accusation implies a training pipeline that would itself be a research breakthrough. Distillation can transfer style and some reasoning behavior. It does not hand you a pretraining run.
What actually matters here is the precedent. Sanctions have been aimed at chips, at fabs, at the people who move hardware. Aiming them at model weights means the US government is treating a model's outputs as a protected asset and the act of learning from them as theft. Every open-weights lab outside the US has to now assume that reading American models is a legal exposure. Every American lab that publishes an API has a new argument for locking it down. The whole open ecosystem gets squeezed from both ends by one press conference.
